Regulation (EU) 2023/2854 of 13 December 2023 on harmonised rules on fair access to and use of data and amending Regulation (EU) 2017/2394 and Directive (EU) 2020/1828 (Data Act; hereinafter the „Data Act“) gives users of smart devices and related digital services the right to know what data their device generates and to actually make use of that data. The Data Act applies in all EU countries.
Put simply, the data generated when you use your device or our digital service belongs first and foremost to you. You have the full right to access it, share it with third parties or use it for your own purposes.
At Domat Control System s.r.o., we act in full compliance with the Data Act. Our goal is to give you full control over your data and to make managing it as simple as possible for you.
The Data Act applies to so-called connected products, i.e. smart devices capable of collecting data (for example photovoltaic systems or heat pumps), and also to related services (for example mobile applications or customer portals).
If we supply you with a connected product or provide a related digital service covered by the Data Act, you will always be informed in advance what data is collected in connection with the given product or service, how it is stored and for what purposes it is used. You will receive this information as part of the pre-contractual or contractual documentation, or in the relevant information sheet.
The user is typically the customer and may be either a natural person or a legal entity, provided they own or use a connected product or digital service.
Under certain circumstances laid down by law, public authorities may also request access to data (for example in the case of an urgent public interest or security crises).
